Terms of Service & Liability
Please read these terms carefully before engaging Divine Shine. They set out the basis on which we provide our services and the limits of our liability.
Important: These terms are provided as a general template and do not constitute legal advice. For full protection tailored to your business and jurisdiction, have a qualified Australian legal professional review this document before relying on it.
1. Acceptance of service
By engaging Divine Shine for any cleaning or restoration service, you accept these Terms of Service in full. If you do not agree with any part of these terms, please do not proceed with a booking.
A formal quote is provided before any work commences. No work is undertaken without your written or verbal approval of that quote.
2. Limitation of liability
Divine Shine provides surface cleaning and restoration services using industry-standard, professional techniques and products. While we take every care, restoration outcomes depend on the existing condition of your surfaces.
To the maximum extent permitted by Australian law, Divine Shine, its owner, employees and contractors are not liable for any pre-existing damage, defects, or wear to glass, stone, chrome, grout, sealants or any other surface that existed prior to our service.
Hard-water staining, etching, mineral scale and similar conditions may not be fully removable where the surface has been permanently damaged. We will advise you honestly where full restoration is not possible before proceeding.
Our liability for any direct loss or damage arising from a service we perform is limited, at our option, to the cost of re-performing the affected service or refunding the portion of the fee attributable to that service.
3. Exclusions of liability
Divine Shine is not liable for: (a) damage caused by pre-existing faults, defective installation, aged or degraded sealants, or structural issues not visible at the time of quoting; (b) damage to items or surfaces not explicitly included in the agreed scope of work; (c) indirect, incidental or consequential losses, including loss of use, loss of enjoyment, or loss of revenue.
We are not responsible for water ingress, mould growth, or deterioration that occurs after the service due to factors outside our control, including ventilation, usage and pre-existing building defects.
Clients are responsible for disclosing any known issues with surfaces, fixtures, or installations prior to the service commencing.
4. Insurance & satisfaction guarantee
Divine Shine is fully insured. In the unlikely event of accidental damage caused directly by our work during a service, we hold public liability insurance to address genuine claims made promptly and in good faith.
Our 100% satisfaction guarantee means that if you are not satisfied with the standard of a completed service, contact us within 48 hours and we will return to address the concern at no additional cost. This guarantee relates to the workmanship of the service performed and does not cover pre-existing conditions or outcomes outside the agreed scope.
5. Bookings, payment & cancellations
Quotes are valid for 30 days. A booking is confirmed once a date and time are agreed. We require at least 24 hours' notice for cancellations or rescheduling; shorter notice may incur a call-out fee.
Payment is due upon completion of the service unless otherwise agreed in writing. Recurring plans are billed per visit and may be paused or cancelled with one week's notice.
6. Contact
For any questions about these terms, a quote, or a service, contact Divine Shine at 0483 804 612 or divineshine000@gmail.com.
